By accessing or using VibeyVenue, you agree to be bound by these Terms and Conditions and our Privacy Policy. If you do not agree, please do not use our platform. These terms are governed by the laws of the Republic of South Africa.

VibeyVenue is an online marketplace that connects hosts who have spaces to rent with guests seeking to book those spaces. VibeyVenue is not a party to the rental agreement between hosts and guests. We facilitate the connection and provide payment processing, email notifications, and dispute resolution services.

You must be 18 years or older to create an account. You are responsible for maintaining the confidentiality of your account credentials. You may not create accounts for others without their consent. VibeyVenue reserves the right to suspend or terminate accounts that violate these terms.

All bookings are confirmed upon successful payment through PayFast. The listed price includes the venue fee and VibeyVenue's guest service fee. VibeyVenue collects 100% of the booking funds upfront and holds them in escrow. We charge a flat 2% platform service fee on all confirmed bookings. This fee is inclusive of all PayFast transaction costs and banking fees. The remaining 98% is guaranteed to the host and is paid out via manual Electronic Funds Transfer (EFT) to their nominated South African bank account within 3 business days following a successful booking date. All prices are in South African Rand (ZAR). VibeyVenue issues tax invoices available from your dashboard.

Hosts warrant that their listing is accurate and that their space complies with all applicable laws, including the South African National Building Regulations, municipal by-laws, and health and safety legislation. Hosts are solely responsible for ensuring their space is fit for purpose. Hosts are required to hold adequate short-term insurance cover for their property before accepting any bookings. We recommend Short Term Brokers (www.shorttermbrokers.co.za) as a specialist in venue and rental cover. VibeyVenue accepts no liability for uninsured or underinsured properties.

VibeyVenue is an online marketplace and is NOT the owner, operator, or insurer of any listed venue. VibeyVenue does NOT accept liability for any damage, loss, injury, or incident that occurs at any venue listed on this platform, whether during or outside a booking period. To the extent permitted by South African law, VibeyVenue's liability to you is strictly limited to the VibeyVenue service fee paid for the relevant booking. We are not liable for any indirect, consequential, incidental, or property-related damages arising from use of the platform or from a booking. The rental agreement and any associated liability remains solely between the host and the guest.

In the event of a dispute between a host and guest, both parties agree to first attempt resolution through VibeyVenue's dispute process. Unresolved disputes are subject to arbitration under the Arbitration Foundation of South Africa (AFSA) rules, with proceedings conducted in English in Johannesburg.

We may update these terms from time to time. We will notify you by email and by posting a notice on our platform. Continued use of VibeyVenue after changes constitutes acceptance of the new terms.
